Dynamite!!USA Sweepstakes Official Rules
No Purchase Necessary to Enter or Win
1. Eligibility: Sweepstakes open to all U.S. citizens legally residing in the 50 United States and the District of Columbia 21 years of age or older. Employees of Showtime Networks Inc., Marden-Kane, Inc., their respective parent companies, subsidiaries, affiliates, advertising and promotional agencies and their immediate families (spouse, parents, children and siblings and their respective spouses) and household members of each are ineligible. Sweepstakes subject to all applicable federal, state, and local laws and regulations. Void in Puerto Rico and where prohibited.
2. How to Enter: No purchase necessary. The Dynamite!!USA Sweepstakes (the "Sweepstakes") begins at 12:00 Noon Eastern Time (ET) on May 14, 2007 and ends at 12:00 Noon (ET) on June 2, 2007 (the "Promotion Period"). Enter online by going to sho.com/sports/sweeps and completing the entry form, then clicking to submit. Limit of one entry per person; any subsequent entries will not be included. All entries received by 12:00 Noon (ET) on May 24, 2007 will be included in the drawing for the Grand Prize. All entries received during the promotion period will be eligible for First and Second Prizes. The Sponsor, Administrator, and any Internet access providers, their respective parents, affiliates, divisions, and agencies and each of the foregoing entities' respective employees, officers, directors, shareholders, and agents (the "Released Parties") are not responsible for incorrect or inaccurate transfer of entry information, human error, technical malfunctions, lost/delayed data transmissions, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, inability to access web sites, damage to a user's computer system (hardware and software) due to participation in this Sweepstakes or any other problem or error that may occur or for late, lost, incomplete, stolen, misdirected, mechanically reproduced, and/or illegible entries. By entering, entrants agree to these Official Rules.
3. Random Drawings/Winner Notifications: One (1) Grand Prize Winner will be selected in a random drawing from all eligible entries received by 12:00 Noon (ET) on May 24, 2007. Drawing will take place on or about May 24, 2007. One (1) First Prize Winner and one hundred (100) Second Prize Winners will be selected in a random drawing from all eligible entries received by 12:00 Noon (ET) on June 2, 2007. Drawing will take place on or about June 4, 2007.
All drawings will be conducted by Marden-Kane, Inc. (Administrator), an independent judging organization whose decisions on all matters pertaining to the Sweepstakes are final. All prizes will be awarded. Odds of winning depend on the total number of eligible entries received. Potential Winners are subject to eligibility verification and compliance with these official rules. Marden-Kane will notify Potential Grand Prize Winner by phone, email, and/or mail within 24 (twenty-four) hours of the Grand Prize drawing. Potential Grand Prize Winner will be required to sign, have notarized and return to Marden-Kane an affidavit of eligibility/release of liability, and, where legal, a publicity release via fax within 24 hours of issuance and via overnight mail within 2 (two) business days of issuance of notification. Potential First Prize Winner will be required to sign, have notarized and return to Marden-Kane an affidavit of eligibility/release of liability, and, where legal, a publicity release within 14 days of issuance of notification. Failure to complete and return the documents in the time noted or if prize notification is undeliverable will result in disqualification and an alternate winner(s) will be selected and notified. Grand Prize Winner must be 21 years of age or older. Travel companions of Grand Prize Winner must also be 21 years of age or older or the child/children of the Grand Prize Winner. Grand Prize Winner's travel companions, or the parent or legal guardian if companion(s) are minors, must sign a consent to publicity (where legal), liability waiver and travel release form prior to traveling. Acceptance of the prize constitutes permission for the Sponsor and its designees to use winner and travel companions' names and likenesses for advertising and promotional purposes without additional compensation unless prohibited by law. Second Prize Winners will receive their prize by regular mail.
4. Prizes: One (1) Grand Prize Winner will receive a trip for four to Los Angeles, CA to see the Dynamite!!USA Mixed Martial Arts Event taking place on June 2, 2007. Trip includes roundtrip coach air transportation from a major airport nearest winner's home within the 50 U.S. and D.C. to the nearest major airport in Los Angeles, two double-occupancy hotel accommodations for two nights (Friday, June 1st and Saturday, June 2nd), four tickets to the Dynamite!!USA Event, and $500 spending money; approximate retail value of trip (ARV): $5,900. One (1) First Prize Winner will receive a Sharp 37" Aquos Widescreen LCD TV; ARV: $1,400. One hundred (100) Second Prize Winners will receive an Official Dynamite!!USA T-shirt; ARV: $25 each. Approximate retail value of all prizes is $9,800. Actual retail value of trip is dependent upon location of winner's residence in relation to Dynamite!!USA Event venue. Grand Prize Winner must agree to take the trip on date specified by Sponsor (June 1, 2007) or an alternate winner will be selected. In the event the closest airport to the Grand Prize Winner's home is within the Event Venue's metropolitan area, prize will not include air transportation from Grand Prize Winner's residence to the Event venue and no other substitution or compensation will be provided in lieu thereof. Any tickets awarded are subject to terms and conditions stated on tickets. Travel subject to availability and confirmation of reservations. Potential Grand Prize Winner and guests must travel together on dates and flights determined by Sponsor or prize will be forfeited in its entirety and may be awarded to an alternate winner. Travel dates are subject to change by the Sponsor. Grand Prize Winner will be notified of actual travel dates. The trip may not be combined with any other offer and travel may not qualify for frequent flier miles. Certain blackout dates, travel restrictions, conditions and limitations may apply. In the event that the selected Event is unable to take place as planned, for reasons including but not limited to scheduling conflicts, cancellations, postponement, an event of force majeure, or for any other reason, then the remaining components of the Grand Prize shall constitute full satisfaction of Sponsor's prize obligation to the Grand Prize Winner, and no other or additional compensation will be awarded. All details of prizes not specified herein shall be determined solely by Sponsor. All taxes, TV installation costs, cable or satellite television subscription/service, and any other expenses not explicitly specified herein are the sole responsibility of winner. No prize substitutions or transfer of prizes permitted except at the sole discretion of the Sponsor due to prize unavailability (including selected Event being cancelled, postponed or pre-empted). Any and all guarantees and warranties for merchandise prizes are subject to the manufacturer's terms and conditions, and winner agrees to look solely to such manufacturer for any such warranty or guarantee claims.
5. Limitations of Liability: Each participant agrees (i) to abide by the terms of these Official Rules and the decisions of the Sponsor and judges which are final and binding on all matters relating to this Sweepstakes, and (ii) to release, discharge, indemnify and hold harmless the Released Parties from any and all claims, actions, and/or liability for any injuries, loss or damage of any kind arising from or in connection with participation in and/or for entry into this Sweepstakes, any related activities, or acceptance or use of any prize won.
6. General Conditions: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. Should this Sweepstakes be terminated, Sponsor reserves the right to select potential winners in a random drawing from among all eligible, non-suspect entries received as of the action requiring such termination. Released Parties are not responsible for any problems or technical malfunction of any computer system, server, or service providers, computer equipment, software, failure of any entry to be received by Sponsor on account of technical problems, human error or any combination thereof, including any injury or damage to participant's or any other person's computer equipment relating to or resulting from participation in this sweepstakes. In the event of a dispute as to who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the person assigned to an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
7. Winners List: For the name of prize winners, after June 2, 2007, send a stamped, self-addressed envelope to Showtime Dynamite!!USA Sweepstakes Winners, c/o Marden-Kane, Dept. KB, 36 Maple Place, Manhasset, NY 11030. Requests received after July 30, 2007 will not be honored.
